Choctaws could change agreement if new chief elected

Chief Martin has pledged that if a nonbinding referendum shows Jackson County residents don't approve of the plans, the casino won't be built.

Whether that agreement would be honored by another chief is the question.
Jackson County Supervisor John McKay, who represents District 5 where the casino would be built, doesn't think the election results will affect the county. He assumes Martin's statement about accepting the results of the referendum had the backing of his tribal council. "I think the same statement would apply to a new chief," McKay said.

Gaming attorney Danny McDaniel said that with a change in leadership in an independent tribal nation, all the agreements change, making them "not as much a contract as a treaty."
